Regulations Regarding Fencing in CITY

We’ve gotten a lot of questions about fencing regulations through our 15+ years in the fencing industry. That’s why we’ve compiled some of the most common ones for Eagan here for you. We do our best to keep these up-to-date, but it never hurts to check your city’s website for confirmation as well.

Where can I place my fence on the property?

As an Eagan property owner, it’s your responsibility to define your property lines clearly. Fencing systems need to be fully assembled within those lines without hindering access to utility easements or blocking traffic visibility and public rights of way, including sidewalks or alleyways. If your neighbors sign an ownership agreement, you can even build a fence directly on your property line.

We will assist you with any fencing or property layout concerns. Utilize our fence planning tool for a great additional resource.

Do I need to notify my neighbors? If so, when?

Even though you have zero legal obligation to notify neighbors of fence construction, it’s still a good idea to do so. This extra thought and effort on your part can create a relationship of open communication, which can be especially beneficial during the installation process.

Do I need a fence permit?

All fences require a permit, but the type varies depending on the height of your fence. A fence under 6 feet in Eagan requires a zoning permit, while one over 6 feet requires a building permit, instead. If you desire a fence over eight feet tall, you’ll need to obtain additional approval for this height. Requirements include an accurate site plan showing all aspects of your property along with your permit application.

Who calls the utilities when installing a fence?

In Minnesota, any fence installation requires you to contact Gopher State One Call. If you work with us, we’ll happily take care of this step for you. Our team will even mark all your utility lines before installation begins. If you choose to do this on your own, don’t forget to call utilities before digging!

What are the height restrictions on fences in Eagan, MN?

Any fence in Eagan over 6 feet tall (to a maximum of 8 feet tall) requires a building permit. Additionally, you will need an extra variance on your permit. Please note that any fence installed in the front setback of your property can not exceed four feet tall.

Can I build my fence on an easement?

We highly encourage you to avoid construction on an easement since the city might need access to it. Before installation starts, connect with the Eagan Planning Department for permission if your fence surrounds an easement.

Are there any design or material restrictions?

Yes. Both electric and barbed wire fences are illegal in Minnesota.
